2. Scope and Application

These Terms and Conditions govern access to and use of the igemail.ai platform and all services made available by Nexora Virex OÜ (hereinafter, "the Service"). They apply to any individual or legal entity that accesses, browses, or uses the Service, regardless of the plan subscribed to.

3. Description of the Service

igemail.ai is a SaaS platform for B2B lead generation and email verification. The Service helps users identify, organise, and export publicly available professional contact data from business profiles, websites, and other public sources for legitimate commercial initiatives that comply with applicable law.

4. Account Registration

Access to the Service requires creating an account by providing accurate and up-to-date information. The user is responsible for:

• Maintaining the confidentiality of their access credentials.
• Notifying Nexora Virex OÜ immediately of any unauthorised use of their account.
• Ensuring that all information provided during registration is accurate and kept up to date.

Nexora Virex OÜ reserves the right to suspend or cancel accounts that breach these Terms.

5. Plans and Pricing

igemail.ai offers different subscription plans with varying monthly credit volumes and features. Prices in effect are those published on the igemail.ai pricing page at the time of purchase. Nexora Virex OÜ reserves the right to modify prices with a minimum of 30 days' prior notice. Active plans will not be affected until the next billing period renewal.

6. Payment

Payments are processed securely through our payment provider (Stripe or an equivalent PCI-DSS certified processor). The main payment conditions are:

• Monthly charge: plans are charged in advance at the beginning of each monthly billing period.
• Automatic renewal: the subscription renews automatically every month unless cancelled in advance.
• Cancellation: you may cancel from your dashboard; cancellation takes effect at the end of the paid period.
• Refunds: no pro-rated refunds are issued for unused time, except where required by law or approved by Nexora Virex OÜ after exceptional review.

Nexora Virex OÜ will issue an invoice for each charge made.

7. Digital Delivery and Shipping Policy

No physical goods are shipped; the service is 100% digital. Access to the platform and subscribed features is delivered online after account activation and payment confirmation where applicable.

8. Acceptable Use

The user agrees to use the Service lawfully, ethically, and in accordance with the terms of the applicable platforms and data sources. The following are expressly prohibited:

• Sending unsolicited communications (spam) to contacts obtained through the Service.
• Conducting email marketing campaigns without complying with applicable regulations, including the GDPR, LSSI-CE, and the CAN-SPAM Act where applicable.
• Using obtained data for illegal, discriminatory, fraudulent activities, or activities that violate the rights of third parties.
• Attempting to circumvent the platform's security measures or access other users' data.
• Reselling or redistributing obtained data to third parties without the express written authorisation of Nexora Virex OÜ.

Breach of these obligations may result in immediate suspension of access to the Service without entitlement to a refund.

9. Public Data — Scope of the Service

igemail.ai only works with professional information that is publicly available. The Service does not access private messages, hidden data, private accounts, or information protected by privacy settings. The user is solely responsible for assessing the legal basis for their campaigns, respecting unsubscribe or objection requests, and ensuring that any commercial communication complies with applicable data protection and commercial communications legislation.

10. Intellectual Property

All intellectual property rights in the igemail.ai platform — including its design, source code, logos, trademarks, text, and other elements — are the exclusive property of Nexora Virex OÜ or its licensors. The user is granted a limited, non-exclusive, and non-transferable licence to access and use the Service as provided in these Terms. Any reproduction, distribution, or unauthorised use of such elements is strictly prohibited.

11. Limitation of Liability

Nexora Virex OÜ does not guarantee uninterrupted availability of the Service or the complete accuracy of displayed data, as these depend on information published by third parties and public sources. To the maximum extent permitted by law, Nexora Virex OÜ shall not be liable for indirect damages, loss of profits, loss of data, or any consequential damages arising from use or inability to use the Service. Nexora Virex OÜ's total liability shall not exceed the amount paid by the user in the 12 months preceding the event giving rise to the claim.

12. Cancellation and Refunds

Users may cancel their subscription at any time from their account settings panel. Cancellation takes effect at the end of the current billing period, with no pro-rated refunds for unused time. Refunds for partial periods will not be issued except as required by applicable consumer protection law or at Nexora Virex OÜ's sole discretion in duly justified exceptional circumstances.

13. Data Protection

The processing of users' personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Any dispute arising from access to or use of the Service shall be subject to the exclusive jurisdiction of the courts of Tallinn, Estonia, unless mandatory consumer protection legislation in the user's country of residence requires otherwise. Nothing in this clause affects the statutory rights of consumers under applicable EU law.

15. Modifications

Nexora Virex OÜ reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated by email or via a prominent notice on the platform at least 15 days in advance. Continued use of the Service after the new terms come into force will constitute acceptance of such changes.
